These policies govern your use of the Business Sarthi platform, operated by Business Sarthi Technologies LLP. Effective date: June 15, 2026. Prepared in line with the Information Technology Act 2000, the DPDP Act 2023, and the Consumer Protection Act 2019.
You may cancel your Business Sarthi subscription at any time. Cancellations are processed on a quarterly billing basis. For example, if you cancel on the 1st of March, your access to paid features continues until the end of the current quarter (31st March) and will not renew thereafter.
Users who avail the Subvention (Free EMI) option for a 1-year subscription term cannot cancel prior to the end of the full subscription term. As a goodwill gesture, users who complete their Subvention plan term will be offered one additional free month of access at the end of their paid term, subject to the then-current terms.
All plans include a 30-day money-back guarantee from the date of your first paid subscription. If Business Sarthi does not meet your expectations within the first 30 days, write to us at support@businesssarthi.com and we will refund the amount you paid — no forms, no arguments.
If you are charged more than once for the same subscription cycle, or a payment is deducted without your subscription being activated, please write to us within 15 days of the transaction. Verified duplicate or failed charges are refunded to the original payment method.
Business Sarthi Technologies LLP (“we”, “us”, “our”) processes personal data in accordance with the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the Information Technology Act, 2000.
We collect only the personal data necessary for the stated purposes and retain it only for as long as required to fulfil those purposes, comply with legal obligations and enforce our agreements. Personal data is protected using industry-standard technical and organisational safeguards including encryption in transit and at rest, access controls and regular security audits.
We do not use Personally Identifiable Information (PII) collected from users for AI training or analysis purposes. AI model training and improvement activities use only anonymised and aggregated data where permitted.
We do not sell personal data. We share personal data only with service providers and subprocessors who help us operate the Platform (under appropriate contractual safeguards), when required by law or a competent authority, in connection with a business transfer (with notice where required), or with your consent. Data is primarily processed and stored within India. Where transferred outside India, we ensure such transfers comply with the DPDP Act and applicable rules.
The Platform is not directed to children under the age of 18. We do not knowingly collect personal data from children. If we become aware that we have collected such data without verifiable parental consent, we will take steps to delete it.
For privacy questions, rights requests or grievances, please write to support@businesssarthi.com. We respond to all valid requests within the timelines prescribed under the DPDP Act.
These Terms of Service form a legally binding agreement between Business Sarthi Technologies LLP and the user of the Platform. By accessing, registering for, or using the Business Sarthi Platform, you agree to be bound by these Terms, our Privacy Policy and the Data Protection Policy Addendum.
All data, tenders, contracts, buyer & seller profiles, contacts and other content available on or derived from the Government e-Marketplace remains the sole property of GeM SPV, the Government of India, and the respective departments, ministries or PSUs that generated it. Users are granted only a limited, revocable, non-transferable licence to view and use such data for their own legitimate internal business purposes, strictly in compliance with the latest GeM General Terms & Conditions and applicable procurement laws.
You must be at least 18 years of age and have full legal capacity to enter into binding contracts. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. We may suspend or terminate any account we reasonably believe is being used in breach of these Terms, the GeM GTC or applicable law.
Access to paid features requires a subscription. Fees, billing cycles and payment terms are as displayed on the Platform or in your order confirmation. All fees are exclusive of applicable taxes. Subscriptions are billed in advance. Cancellation and refund entitlements are governed by the Cancellation Policy and Refund Policy above.
To the maximum extent permitted by applicable Indian law, the Platform and all content, insights, AI outputs, reports, alerts and features are provided “as is” and “as available”, without warranty of any kind. We disclaim all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
In no event shall the Company be liable for indirect, incidental, special, consequential, punitive or exemplary damages, including loss of profits, revenue, business opportunities, data or goodwill. Our total aggregate liability under these Terms shall not exceed the total subscription fees actually paid by you to us in the twelve (12) months immediately preceding the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded under Indian law, including under the Consumer Protection Act, 2019 where you qualify as a “consumer”.
We retain all right, title and interest in the Platform, including software, algorithms, ML models, analytics methodologies, dashboards and derived insights (excluding raw GeM Data, which remains Government property). You retain ownership of your User Content, and grant us a worldwide, royalty-free, non-exclusive licence to use it solely to provide, maintain and improve the Platform (including AI model refinement in anonymised and aggregated form, where applicable).
These Terms are governed by the laws of India. Any dispute will first be attempted amicably; failing which, it shall be referred to arbitration administered by the Delhi International Arbitration Centre (DIAC), seated in New Delhi, in accordance with the Arbitration and Conciliation Act, 1996. The courts at New Delhi shall have exclusive jurisdiction over any matters not subject to arbitration.
We may modify these Terms at any time. Material changes will be notified by email to your registered address or by prominent notice within the Platform. Your continued use of the Platform after the effective date of any changes constitutes acceptance of the modified Terms.
